8,055 Accredited Salespersons released by PRC last Feb 15,2017

After a long wait,  the list of approved applicants  for Accreditation of Real Estate Salespersons  at PRC were released last February 15, 2017.  There are 8055 Salesperson from 164 resolutions dated from Jan 29, 2016 to December 23, 2016.   Real Estate Salespersons are not required to take examinations but should work under the supervision  and accountability of a Licensed Real Estate  Broker. (Sec 31 RA 9646)   Brokers are only allowed to accredit maximum of twenty (20) Real Estate Salespersons.

Section 31. Supervision of Real Estate Salespersons. – For real estate salespersons, no examination shall be given, but they shall be accredited by the Board: Provided, That they have completed at least two (2) years of college and have undergone training and seminars in real estate brokerage, as may be required by the Board. Real estate salespersons shall be under the direct supervision and accountability of a real estate broker. As such, they cannot by themselves be signatories to a written agreement involving a real estate transaction unless the real estate broker who has direct supervision and accountability over them is also a signatory thereto. No real estate salesperson, either directly or indirectly, can negotiate, mediate or transact any real estate transaction for and in behalf of a real estate broker without first securing an authorized accreditation as real estate salesperson for the real estate broker, as prescribed by the Board. A real estate broker shall be guilty of violating this Act for employing or utilizing the services of a real estate salesperson when he/she has not secured the required accreditation from the Board prior to such employment.

No salesperson shall be entitled to receive or demand a fee, commission or compensation of any kind from any person, other than the duly licensed real estate broker who has direct control and supervision over him, for any service rendered or work done by such salesperson in any real estate transaction.

 

          For the general public to check if the real estate salespersons offering properties or real estate services to you, make sure they have proper identification cards from PRC.  You may also check the names of their brokers.

How To Eradicate Colorums or Illegal Real Estate Practitioners

For many years, even at the imposition of RA 9646 or RESA law in 2009,  colorums or illegal practitioner still abound and do not seem to mind the law with its hefty fines and imprisonment of minimum of four years per violation for those practicing without proper licenses. Why is this so?  Again, we have many laws waiting to be fully implemented .  While our regulatory agencies  (PRC-PRBRES  and HLURB) are sleeping (?) on their job or only concerned about the already legitimate pay their licenses every  year, the illegal practitioners  proliferate and multiply and laughing their way to the banks as developers do not mind whether they are licensed or not for as long as they bring in sale!

Dear fellow Brokers,  how can we help eradicate illegals?    After all, we are losing businesses to colorums so why not help in eradicating them. Unless you belong to the group who  recruits these illegals, making them get sales without bothering to register these agents, then you are also violating the law and we should also run after you? Do not just complain that there are many of them out there.  WE KNOW THAT! But what are you doing to help?

First, let us the legitimate Real Estate Brokers,  be the change that we want to see!   Start by not dealing with these illegals. Do not inquire for their listings or accept their inquiries!  When you have to recruit agents, recruit only those who are qualified under RA 9646.  Send them to attend CPE for salespersons and register them to PRC and HLURB before sending them out to sell.

Second, in all your advertisements, always display your PRC REB license numbers, your PTR, your HLURB numbers. That is separating ourselves from illegals. So that the public can distinguish who are legitimate because we have those displayed in our tarpaulins, business cards, websites!  Use our real names in social media, not the aliases like the way colorums do business!

Third, do not rent out your licenses. We have received information that there are developers renting   licenses of Brokers.  Brokers are supposed to manage their own agents that is why we were only allowed to accredit maximum of  twenty (20) salespersons. Why are they registered under your name but working with a different sales managers in a developer’s project you are not even accredited? For measly sum of P500 per month?? Your PRC license is only worth P500 a month??  You spent 120 hours sitting in a seminar, countless sleepless night to review for board exam only to rent out your licenses? Some realty companies are also operating out of rented Real Estate Broker’s licenses.

Fourth,  if you see colorums’ ads, those distributing fliers in malls that do not have proper registration, get their fliers as evidence. Screenshots their ads and email to HLURB and PRC!  Make your voice count! After all, we do pay our dues to them. They have to protect us! They should do their mandate to us and protect us from these illegals!

Fifth,  why not help  file a case against these illegals if you encounter a client they victimized? Many buyers who are victims of illegal practitioners thinks we are all scammers because of them.  Their victims maybe not aware of RA 9646 and it is our duty to inform them about the law that enable us to practice real estate legally.

Last December 29, 2016,  the Professional Regulation Commission released a   list of about 550 Salespersons approved for accreditation as Real Estate Salesperson.  The list can be downloaded fom their website through this link.

Real Estate Salespersons do not take Board Examinations but are accredited through the endorsement of Real Estate Brokers who are allowed to register twenty (20) Salespersons.

Qualifications of Real Estate Brokers

        Every real estate transaction would entail many legal implications, not to mention factors like the structures on the property, financing, rights among other consideration such that, each transaction should be supervised by a competent practitioner. The government recognizes the role of real estate service practitioners in stimulating economic activity through the real estate marketing and developments in major cities and countrysides. These real estate activities enhances the income of the government by way of taxes revenues, its multiplier effect that brings more jobs and income that contribute to the economy.

           This important role of real estate service practitioners in the social and economic development of the country need to be regulated and developed to be technically competent to serve the increasing demands of the property sector.

           To make sure you are dealing with a real estate professional, here are what you need to know about a Real Estate Broker:

  1. He/She is a holder of a Baccalaureate degree.
  2. He/She has taken and passed the PRC Licensure Examination for Real Estate Broker or previously registered  with DTI and granted registration without examination via the grandfather’s clause of RA 9646.
  3. Holder of a PRC-issued Real Estate BRokers ID (with corresponding License number)
  4. He/She is continually attending seminars/training within the span of three (3) years in compliance with PRC’s continuing Professional Development (CPD) Program.
  5. He/She is “bonded” by a surety bond in the exercise of his/her profession. (The only profession under PRC that requires bond)
  6. He/She is bound by Code of Ethics of Professionals.
  7. He/She is allowed to supervise only 20 accredited Salesperson under his/her name.
  8. He is a holder of an HLURB issued ID when dealing with developer’s projects.
  9. He is also “bonded” by a surety bond in favor of HLURB in the exercise of his/her engagement in project selling.
  10. By definition of law (RA 9646), a Real Estate Broker is a duly registered and licensed natural person (not a realty or corporation), who for a professional fee, commission or other valuable consideration, acts as an agent of a party in real estate transaction to offer, advertise, solicit, list, promote, meditate, negotiate or effect the meeting of the minds on the sale. purchase, exchange, mortgage, lease, or joint venture, or other similar transactions on real estate or any interest therein.

Section 29. Prohibition Against the Unauthorized Practice of Real Estate Service. – No person shall practice or offer to practice real estate service in the Philippines or offer himself/herself as real estate service practitioner, or use the title, word, letter, figure or any sign tending to convey the impression that one is a real estate service practitioner, or advertise or indicate in any manner whatsoever that one is qualified to practice the profession, or be appointed as real property appraiser or assessor in any national government entity or local government unit, unless he/she has satisfactorily passed the licensure examination given by the Board, except as otherwise provided in this Act, a holder of a valid certificate of registration, and professional identification card or a valid special/temporary permit duly issued to him/her by the Board and the Commission, and in the case of real estate brokers and private appraisers, they have paid the required bond as hereto provided.

 

For those who are connected with developers and thinks that having a company ID is legal practice, it is not.

 

Section 31. Supervision of Real Estate Salespersons. – For real estate salespersons, no examination shall be given, but they shall be accredited by the Board: Provided, That they have completed at least two (2) years of college and have undergone training and seminars in real estate brokerage, as may be required by the Board. Real estate salespersons shall be under the direct supervision and accountability of a real estate broker. As such, they cannot by themselves be signatories to a written agreement involving a real estate transaction unless the real estate broker who has direct supervision and accountability over them is also a signatory thereto. No real estate salesperson, either directly or indirectly, can negotiate, mediate or transact any real estate transaction for and in behalf of a real estate broker without first securing an authorized accreditation as real estate salesperson for the real estate broker, as prescribed by the Board. A real estate broker shall be guilty of violating this Act for employing or utilizing the services of a real estate salesperson when he/she has not secured the required accreditation from the Board prior to such employment.

No salesperson shall be entitled to receive or demand a fee, commission or compensation of any kind from any person, other than the duly licensed real estate broker who has direct control and supervision over him, for any service rendered or work done by such salesperson in any real estate transaction.

No violation of this provision shall be a cause for revocation or suspension of the certificate of registration of the real estate broker unless there was actual knowledge of such violation or the broker retains the benefits, profits or proceeds of a transaction wrongfully negotiated by the salesperson.

Section 39. Penal Provisions, – Any violation of this Act, including violations of implementing rules and regulations, shall be meted the penalty of a fine of not less than One hundred thousand pesos (P100,000.00) or imprisonment of not less than two (2) years, or both such fine and imprisonment upon the discretion of the court. In case the violation is committed by an unlicensed real estate service practitioner, the penalty shall be double the aforesaid fine and imprisonment.

In case the violation is committed, by a partnership, corporation, association or any other juridical person, the partner, president, director or manager who has committed or consented to or knowingly tolerated such violation shall be held directly liable and responsible for the acts as principal or as a co-principal with the other participants, if any.

Click Begin Search and type the family name of the person and click Start Search. All those listed with similar family names will appear. If they are not there, they are most probably not licensed. Require them to show you a PRC ID and HLURB ID.

HOW TO KNOW IF YOU ARE DEALING WITH LEGITIMATE REAL ESTATE SERVICE PROFESSIONALS

            RA 9646 or better known as RESA (Real Estate Service Act) became a law on July 15, 2009.  This law prohibits real estate service practice without proper license. Violation of its provisions is punishable by fines and imprisonment of not less than TWO (2) years and ONE HUNDRED THOUSANDS PESOS (P100,000.00) in fines or double for non-licensed practitioners (Sec. 39). This law also paved the transfer of licensing of Real Estate Service Practitioners under the supervision of the Professional Regulation Commission where Brokers, Appraisers, Consultants will have to pass respective Board exams to be able to practice. As such, it also created a new four-year college degree, Bachelor of Science in Real Estate Management. Only those who graduated from Bachelor of Science in Real Estate Management can take the Board exams for Real Estate Service.

           As of May 2016, there are already  about 31,000 duly Licensed Real Estate Brokers,  9,000 + duly Licensed Real Estate Appraisers and about 180 Real Estate Consultants registered with PRC. Their names can be verified at the PRC website through this   link –  . You need to know their full name then choose the profession on the drop down menu.           However, in many cases that you do not have the full name as most business card or in everyday dealings, we only get their nicknames and family names, and you need other information like their PRC number, their location of business and if a member of a local real estate board or association, you have two sites to check them out. To verify a  Broker, Appraiser or Consultant –

          To find a Broker, Appraiser or Consultants, just type family name on the Search box, followed by comma and then click Search. All listed with similar family names will appear. You may check from the names that appeared the practitioner you are looking for. Other info you will see about the Real Estate Service Professional (RESP) are the date of examination or the Resolution number for those who availed of the grandfather’s clause of  RA 9646. Those who availed the grandfather’s clause  no longer have to take the Board Exam as they were licensed previously under DTI.  You will also find their PRC license numbers and whether they are Brokers, Appraisers, Consultants or carrying all three licenses for Real Estate Service, their affiliation and location. Not all in the list have these info are voluntary.
